NOTICE OF INTENT TO SUBMIT STATE PLAN AMENDMENT AND SOLICITATION OF PUBLIC INPUT The Idaho Department of Health and Welfare Division of Medicaid (Department) provides public notice of impending changes to the Idaho Medicaid State Plan and/or CHIP State Plan, as required by 42 C.F.R. § 447.205. The Department assures these changes are in compliance with 42 CFR§ 440.345, 42 CFR§ 440.386, 42 CFR§ 447.204, 42 CFR§ 447.205, 42 CFR§ 457.30, and with the provisions of section 5006(e) of the ARRA of 2009. Medicaid has solicited input from Idaho’s Tribal representatives regarding these changes in compliance with section 5006(e) of the American Recovery and Reinvestment Act of 2009 and its Tribal Consultation Policy. The Department also assures that individuals under twenty-one (21) years of age, pursuant to EPSDT, may receive additional services if determined medically necessary and prior authorized by the Department. PROPOSED CHANGES Idaho Medicaid intends to submit application to the Centers for Medicare and Medicaid Services (CMS) for a Title XIX and XXI State Plan Amendment (SPA) to update Section 4.22 regarding Medicaid Third Party Liability (TPL). Specific changes include: • The requirement to apply cost avoidance procedures to claims for prenatal services, including labor, delivery, and postpartum care services; • The requirement to make payments without regard to potential TPL for pediatric preventive services, unless the state has made a determination related to cost-effectiveness and access to care that warrants cost avoidance for ninety (90) days; and • Flexibility to make payments without regard to potential TPL for up to one hundred (100) days for claims related to child support enforcement beneficiaries. • Compliance with TPL for parties legally responsible through agreements or contracts to pay for care and services. These changes are required under both the Bipartisan Budget Act (BBA) of 2018 and the Medicaid Services Investment and Accountability Act (MSIAA) of 2019 affecting the BBA of 2013. The effective date for these changes is January 1, 2022. ESTIMATE OF EXPECTED CHANGE IN ANNUAL AGGREGATE EXPENDITURES There is no expected increase or decrease in annual aggregate expenditures.
