ORDINANCE NO. 19-3
AN ORDINANCE OF THE CITY OF MURTAUGH, IDAHO, ADOPTING
AND ASSIGNING A ZONING DESIGNATION TO EACH OF THE
PARCELS OF PROPERTY ANNEXED INTO THE CITY LIMITS OF THE
CITY OF MURTAUGH, IDAHO IN ORDINANCE NO. 19-2; REPEALING
ALL CODE SECTIONS, COMPREHENSIVE PLAN, ZONING
ORDINANCES OR PARTS THEREOF IN CONFLICT WITH THE
HEREIN ORDINANCE; AUTHORIZING THE MAYOR AND CITY CLERK
OF THE CITY OF MURTAUGH TO EXECUTE THIS ORDINANCE
ASSIGNING A ZONING DESIGNATION CONSISTENT WITH THE
ANNEXATION PLAN AS SET OUT IN ORDINANCE NO. 19-2; AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, the City of Murtaugh, Idaho, deems it necessary to protect
and promote the public health, safety and community welfare of the City
of Murtaugh, and
WHEREAS, the City of Murtaugh, Idaho, anticipates future growth and
the need for orderly development including but not limited to present and
future annexation, and
WHEREAS, the City of Murtaugh, Idaho, has, previously, by Ordinance,
annexed certain lots/parcels into the City limits as set out in Ordinance
No. 19-2 and have in Ordinance No. 19.2 listed the landowners of the
parcels of property annexed as well as the legal descriptions; said list
of owners and legal descriptions are attached to said Ordinance No.
19.2 as Exhibits A and B, respectfully and set out as to location on the
Annexation Map attached to said Ordinance No. 19.2 as Exhibit C; and
WHEREAS, the City of Murtaugh, Idaho, has seen a need to assign
zoning designations to said annexed parcels of property; and
WHEREAS, a draft of this present Ordinance was considered by the
Murtaugh City Council and was discussed at a duly noticed public
hearing on the 22nd day of January 2019; and
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF MURTAUGH, IDAHO:
1. Integration of Recitals: The recitals set forth in this Ordinance are
incorporated herein and by this reference made a part hereof as
though set forth in full herein.
2. Annexed Parcels: The parcels of property annexed into the City
Limits of the City of Murtaugh in Ordinance No. 19.2 are listed and
described therein by number in Exhibits A and B and are shown
on the Annexation Map attached to said Ordinance No. 19.2 as
Exhibit C. Said Exhibits A, B and C to Ordinance No. 19.2 are
incorporated herein by reference as though set forth in full herein.
The Parcel numbers used to reference the annexed parcels as
set out hereafter in paragraph 3, in said Exhibits A, B and C
attached to Ordinance No. 19.2 are hereafter used in referencing
and describing the parcels which are hereby given the zoning
designations as set out hereafter in paragraph 3.
3. Designated Parcels: The previously annexed parcels set out
(by the same Parcel Nos. used in Exhibits A and B attached to
Ordinance No. 19.2) in this paragraph 3 are hereby given the
following zoning designation(s):
a. Parcel Nos. 1, 2, 7, 8 and 9 are hereby assigned the zoning
designation of Medium Density Residential.
b. Parcel Nos. 3, 4, 5, 6, 10 and 13 are hereby assigned the
zoning designation of Mixed Use.
4. Repeal of Conflicting Provisions: All Ordinances, Comprehensive
Plan, Zoning Ordinances, provisions, amendments and code
sections or parts which conflict with this Ordinance are hereby
repealed.
5. Severability: This Ordinance is hereby declared to be severable.
Should a court of competent jurisdiction declare any portion of
this ordinance invalid, the remaining provisions shall continue
in full force and effect and shall be read so as to carry out the
purpose(s) of the Ordinance before the declaration of partial
invalidity.
6. Effective Date: The effective date of this Ordinance shall be the
3rd day of May 2019.
PASSED by the City Council of the City of Murtaugh, Idaho on the 22nd
day of January 2019 and APPROVED and made Effective by the Mayor
of the City of Murtaugh, Idaho on the 3rd day of May 2019.
