BUHL • A Buhl man who was arrested on charges of watching pornography in the presence of an infant has now been charged with lewd and lascivious conduct with a child under 16.
Miguel Angel Medina-Mariscal, 37, was arrested after Twin Falls County sheriff’s deputies responded to a home on 3700 North, south of Buhl. Deputies discovered he had two warrants out for his arrest from California, one on a lewd conduct charge and one connected with possession of a controlled substance.
At the time of the arrest a woman told police the baby was lying on the bed and Medina-Mariscal was masturbating close to the baby while pornography was playing on a television in the room, according to a police report. The report states the woman could not tell if Medina-Mariscal touched the baby.
Later in a Jan. 31 interview with Children at Risk Evaluation Services, the woman said she did see Medina-Mariscal touch the baby with his genitals, the report states.
Medina-Mariscal allegedly asked for forgiveness and said he would never do it again when he asked the woman not to call police, the report states. The report states Medina-Mariscal admitted to his family that he attempted to rape the infant, but he said he stopped and he was sorry.
Medina-Mariscal is being held at the Twin Falls County Jail on a $1 million bond for his California warrants and a $300,000 bond on his new lewd conduct charge in Twin Falls County. A preliminary hearing is scheduled for Feb. 11.
