RUPERT — Prosecutors have struck a plea deal with a Rupert man who police say choked a 16-year-old girl and cut her with a shard of glass after she told him to stop kissing her.

Case Weems, 18, was originally charged with felony injury to a child.

Minidoka County Prosecutor Lance Stevenson said Weems has agreed to plead guilty to a reduced charge of misdemeanor battery.

The amended charge states that Weems touched or struck the girl and threw her to the ground, placing a choke hold on her. She was unable to speak and started to lose consciousness.

Police said the girl met Weems at a shed near a Rupert supermarket. Inside the shed, Weems started kissing her and attacked when the girl told him to stop and hit him with her elbow.

The girl took a piece of broken glass when she left the shed because she was scared Weems would assault her again, police said. Investigators found blood and pieces of glass inside the shed.

Weems, who went to the hospital emergency room to treat cuts on his hands, told police he’d been cut when he fell on broken glass near the store.

A change-of-plea and sentencing hearing was set for Tuesday in Minidoka County Magistrate Court.
